QPSX Ltd provides the following update in respect of the case management conference held today in QPSX's case against Ericsson and others in the Federal Court of Australia.
The case concerns a licence agreement executed between QPSX and Ericsson which provides for payment by Ericsson of royalties at a rate of 5% on Ericsson's global use of ATM Products for the first year from 1 July 2003 and 3% for subsequent years. QPSX is seeking damages for breaches of the licence agreement, as well as for misleading and deceptive conduct in contravention of the Trade Practices Act 1974 (Cth).
At today's conference, Justice French heard argument on various issues. His decision on these disputed issues was postponed until the next hearing, scheduled for 2 August 2006. The parties were ordered to provide further written submissions on the outstanding issues prior to the next hearing. The parties were also ordered to consult with the Court with a view to administratively fixing a date for trial in March or April 2007.
