The Australian Securities and Investments Commission has disqualified the founder and chief executive of labour hire company Ochre Workforce Solutions from managing companies for five years.
ASIC said Joanne Pellew was disqualified after liquidators were appointed to various training and labour hire businesses that she operated – namely Ochre Training, Ochre Training (WA) and Ochre Workforce Solutions – and found her management of these companies to be a contributing factor in their collapse.
The commission found Ms Pellew had failed to exercise her duties as director with due care and diligence and failed to ensure proper financial records were kept and that the companies paid all relevant taxes, amongst other findings.
The total amount of debts owed by the companies to creditors exceeded $4.5 million.
ASIC said it relied on supplementary reports outlining possible offences, lodged by the liquidators of Ochre Training and Ochre Training (WA), in its decision to disqualify the director.
It said funding from the Assetless Administration Fund was provided to the liquidator of Ochre Training (WA) to assist in preparing a supplementary report.
Ms Pellew is disqualified from managing companies until October 27, 2024.
She established Ochre Workforce Solutions in 2010.
